La sentencia declaró probado que el procesado actuó recibiendo diversas cantidades económicas que finalmente no llegó a devolver a la empresa en cuyo nombre actuaba.La Audiencia le impuso como responsabilidad civil una indemnización solidaria conjunta con la sociedad mercantil Sungest de una cantidad de 370.000 euros, que equivalía a los 61,5 millones de pesetas con valor del año 1993, para los 74 perjudicados, la mayoría matrimonios, que se personaron en la causa procedentes en su mayoría de Castilla y León, Cantabria, País Vasco, Asturias, La Rioja, Galicia y Balears. Concretamente, los matrimonios y otras parejas afectadas de Castilla y León residen en Valladolid, Palencia, Burgos, Segovia y León. El Supremo, sin embargo, ha admitido el recurso de Sungest, que finalmente no tendrá que asumir esa indemnización solidaria junto al promotor.
La Audiencia Nacional, en su sentencia de diciembre de 2005, consideró que el procesado, en su condición de socio y administrador de la mercantil Módulos Turísticos, con domicilio en Oviedo y cuyo objeto social era la comercialización de iniciativas y promociones turísticas y de ocio, había entablado relaciones comerciales verbales, al menos desde 1991, con la empresa Sungest.
Esta empresas es propietaria de apartamentos en régimen de multipropiedad en Eivissa, por la cual ésta última cedía a la primera, a cambio de una comisión, las gestiones en el norte de España para captar clientes. Los citados apartamentos estaban en la isla y, entre ellos, el residencial identificado como Port des Torrent-San José o Ses Bledes.
