Una empresa de multipropiedad deberá devolver a un matrimonio asturiano 23.740 euros al ser condenada por un tribunal de Bilbao tras considerar nulo un contrato que, según la sentencia, se suscribió bajo engaños. La pareja en cuestión, que demandó a la empresa, suscribió un contrato privado para disfrutar de siete noches de alojamiento al año en un complejo vacacional de Marbella.
En la sentencia se recoge que "la firma del contrato se produjo haciendo uso de tácticas comerciales no admisibles en el ámbito del derecho del consumidor". La utilización de las técnicas agresivas de venta son habituales en el negocio de la multipropiedad a pesar de que en 1998 se aprobó una ley para poner coto a los abusos.
"Cuando me dijeron que había firmado un contrato y que podían quitarme el piso si no lo cumplía, casi me muero; porque creíamos que lo que se firmó era un viaje de ocho días a Marbella, por 625 euros más el cheque de 325 que nos regalaban", explicó I.C.G., que vive con su marido y su hija en Sama de Langreo y que trabaja como dependienta. La familia ha salido perjudicada porque la sentencia sólo condena a la agencia a pagar los 23.470 euros del contrato de multipropiedad, pero los demandantes se vieron obligados a suscribir un crédito, por lo que también pedían el pago de 8.164 euros en concepto de intereses que les ha sido denegado.
La pareja asturiana suscribió un contrato del que luego, una vez conocidas las consecuencias, se echaron atrás y demandó. La sentencia considera que se dio "un consentimiento viciado en el momento de la firma del contrato debido a las maquinaciones y engaños desplegados por la demandada". La jueza dice que el contrato no contenía la información mínima "legalmente exigible" por la ley sobre derechos de aprovechamiento por turno de bienes inmuebles de uso turístico.
"Fuimos mi marido y yo y allí nos pasaron un vídeo de muchos lugares del mundo, para ir de vacaciones. Luego nos sentamos en una mesa donde una chica nos explicó lo de la multipropiedad, le dijimos que no nos interesaba, pero nos lió con lo de las vacaciones de ocho días", explicó I.C.G. La familia insiste en que siempre pensaron que sólo firmaban los ocho días. "Pero te daban unos papeles donde la letra pequeña era diez veces más pequeña que la letra del anuncio del cheque", cuenta.
El fallo entiende que hay dolo porque la empresa, Aprovechamiento Anual de Bienes Turísticos 2050 S.L. (AABT), empleó "palabras o maquinaciones insidiosas" sin las cuales los demandantes no hubrían firmado. "Mi madre todavía no lo sabe y no quiero que se entere de lo que ha pasado hasta que tenga el dinero en la mano", explica esta vecina de Sama de Lagreo. La sentencia es recurrible.
