La "mala fama" de las casas en multipropiedad en España se debe a las "técnicas de marketing muy agresivas" de los proveedores, tal y como ha asegurado en declaraciones a Europa Press Emilio Blanco, experto en derecho de contratos y profesor universitario, que participó en un curso de verano de la UIMP, en Santander.....
Blanco explicó que los probables clientes "se retraen" ante la forma de captar contratos de este tipo de empresas, en que "convocan a varias personas en un hotel y mediante técnicas de captación muy fuertes pretenden hacerles firmar allí mismo sin que tengan casi tiempo para pensar", opción que el profesor de la Universidad Autónoma de Madrid consideró "erróneo" por provocar "ansiedad" en los asistentes al acto y su posible "marcha atrás" cuando llegan a su casa.
No obstante, Blanco indicó que las "numerosas" quejas de los consumidores sobre este tipo de contratos motivó que España dictara la Ley de por Turno de Bienes Inmuebles, que desde el año 1998 ampara a los contratantes de este servicio al mismo nivel europeo. Desde la promulgación de esta ley, los fraudes en multipropiedad "siguen existiendo" pero el nivel de cobertura de defensa del consumidor es "mucho mayor a lo que existía antes", dada la "complejidad" de este sistema de propiedad, que permite el disfrute de una casa o apartamento entre varias personas por el tiempo pactado en el contrato.
Los viajes combinados fue otro de los sectores en los que actualmente los consumidores españoles tienen la misma protección jurídica que el resto de los europeos, y cuyo funcionamiento es "razonablemente normal" a juicio de Blanco, quien añadió que una de las mayores quejas de los contratantes de estos servicios es "la falta de atención de la agencia de viajes cuando existe un problema".
En este sentido, el especialista en Derecho de consumo indicó que los clientes han de leerse bien la letra pequeña de los contratos para que en el caso de que se produzca un altercado, "bien con el vuelo, bien con el hotel, o en una excursión programada" sepan cómo actuar y exigir a la agencia "lo pactado, lo que se merecen, porque es lo que han pagado".
No obstante, Blanco indicó que los viajes combinados, al estar cada vez más solicitados, "es lógico que también aumenten su índice de quejas", pero "cada vez están más asentadas y ofrecen condiciones de garantía a los usuarios, sobre todo las empresas grandes".
Emilio Blanco clausuró con esta ponencia el curso 'Derecho de consumo y derecho de contratos' que junto a los catedráticos Luis Díez-Picazo y José María Miquel ofreció durante toda la semana en el santanderino Palacio de la Magdalena.
