La Audiencia de Málaga ha confirmado la sentencia impuesta contra un hombre por estafar casi 30.000 euros a una pareja a la que engañó para llevar a cabo una operación de adquisición de un derecho de aprovechamiento por turnos que el matrimonio tenía, haciendo pasar, incluso, a una persona como notario.
Un Juzgado consideró probado, según se recoge en la sentencia de la Sala, a la que tuvo acceso Europa Press, que el acusado y otras personas no identificadas contactaron en julio de 2003 con una pareja para una operación comercial que consistía en la adquisición de un derecho de aprovechamiento que tenía el matrimonio en Gran Canaria.
Para ello, remitieron varios fax e incluso hicieron a una persona hacerse pasar por notario. El acusado fue el encargado de abrir varias cuentas en sucursales bancarias de la localidad malagueña de Fuengirola, donde los acusados realizaron diversos ingresos hasta llegar a la cantidad defraudada de 29.898 euros.
El juzgado impuso al hombre por un delito continuado de estafa la pena de dos años de prisión, condena que el Tribunal de apelación ha ratificado, desestimando el recurso presentado por la defensa del procesado, que solicitó la absolución de su defendido o que se rebajara la pena.
Se argumenta que el acusado es "parte del entramado organizativo" y tuvo "una participación relevante y esencial en los hechos, por los que, mediante engaño, haciendo creer que se harían operaciones de venta de multipropiedad, se consigue de los perjudicados, llegándose a aparentar una intervención notarial, un desplazamiento de dinero".
