Noticia Diario Critico El abogado de la Asociación de Consumidores Afectados por Mundo Mágico (Acama), con email de contacto: correo@afectadosmultipropiedad.com Damián Vázquez, ha destacado este jueves que si la compañía valenciana Traveltur Hotels y Resorts "no acepta las reclamaciones" y no devuelve las cantidades invertidas por sus clientes presentará "una demanda ante los juzgados". En concreto, cientos de familias han sido las afectadas, y no podrán disfrutar de sus vacaciones después de que la titular del Juzgado de lo Mercantil número diez de Madrid haya declarado el concurso voluntario de acreedores para la compañía Traveltur Hotels y Resorts, en virtud de un procedimiento por auto de fecha 20 de julio de 2010.
Así, en declaraciones a Europa Press, Vázquez ha indicado que habrá que ver si Traveltur Hotels y Resorts, que ha vendido semanas de multipropiedad a matrimonios de toda España, últimamente para el complejo Aquarius de Lanzarote desde el año 2008, abona la inversión de los afectados y si no se procederá a la denuncia.
El abogado de Acama ha relatado cómo operaba la compañía. En principio, se captaba a los consumidores mediante una llamada o una carta, en la que, con "la promesa de un premio" se les citaba a una reunión de unas cuatro horas "donde se les bombardeaba con técnicas comerciales de presentación de la multipropiedad".
Los clientes firmaban un contrato de aprovechamiento por turnos de bienes inmuebles turísticos en el Complejo Aquarius de Lanzarote, por un importe aproximado de 15.750 euros, con el que disfrutarían de una semana de vacaciones en dicho complejo.
En estos casos en base a acuerdos que tenían con una sucursal de Bancaja en Valencia les colocaban un préstamo con dicha entidad para abonar la multipropiedad, que tienen que seguir abonando los afectados en estos momentos.
Asimismo, según se desprende de la página web de la asociación de consumidores, se ha podido comprobar que otras empresas de multipropiedad actuaban de una forma similar, con contratos parecidos y con préstamos con Bancaja, también para el Complejo Aquarius de Lanzarote, así como los complejos Ogisaka Garden de Dénia y Flamingo Albir Garden de Alfàs del Pi, entre otras.
Estas empresas con más afectados y reclamaciones, según ACAMA, serían General Tours, Transvaciones Hotels, Turihoteles, Royas Vacaciones Resorts, Europlayas Hoteles y Resorts, ya que la asociación ha comprobado que utilizan el mismo tipo de denominación social, y que se dedican todas a la multipropiedad.
Por último, Vázquez ha manifestado que aunque es difícil estimar cuantos han sido los afectados, debido a que la empresa ha cambiado de nombre en varias ocasiones, la cifra asciende a cientos de familias.
Además, ha indicado que debido a que hay sentados precedentes en casos de multipropiedad, se acudirá al juzgado para que los afectados "aunque sin vacaciones pueden recuperar su dinero".
En último término, el abogado de la asociación ha destacado que algunos matrimonios, con más suerte, les han informado de que en alguna ocasión han podido disfrutar de estas vacaciones, aunque en los meses -enero y febrero- en los que generalmente no se dispone de tiempo de ocio, mientras que, con anterioridad, muchas otras familias les han manifestado que no han podido disfrutar de su inversión.
Suspensión de pagos
En concreto, se ha declarado el concurso voluntario de acreedores para la compañía Traveltur Hotels y Resorts, según publica el Boletín Oficial del Estado (BOE). El deudor conservará las facultades de administración y disposición de su patrimonio, pero éstas estarán sometidas a la intervención de la administración concursal.
Queda abierto además el plazo para que los acreedores pongan en conocimiento de la administración concursal la existencia de sus créditos, que se extenderá por un mes a partir de la comunicación de la resolución.
Los acreedores e interesados que deseen comparecer en el procedimiento deberán hacerlo por medio de un procurador y asistidos por un letrado, tal y como dicta el artículo 184.3 de la Ley Concursal.
