PRIMERO.- El primer motivo del recurso de apelación consiste en denunciar infracción de los arts. 11 y 12 de la Ley 42/1998 de 5 de noviembre , argumentando que el primer artículo ha sido indebidamente aplicado, y el segundo, indebidamente inaplicado.
Resulta relevante para la resolución de este primer motivo recordar que las partes concertaron el 4 de junio de 2000 un contrato de transmisión de derechos de aprovechamiento por turno conviniendo un precio contractual de 2.475.000 pesetas; que el 7 de junio de 2000 los actores suscribieron con el Banco de Comercio un préstamo por importe de 2.475.000 pesetas; que el mismo 7 de junio ordenaron el traspaso de la cantidad prestada a una cuenta de Royal Guest, SL.
De esos acreditados hechos se desprende sin ninguna duda que ese traspaso de 2.475.000 supuso pago del precio convenido, y que el mismo, atendidas las fechas, se hizo con antelación al vencimiento de los plazos de desistimiento/resolución fijados en el art. 10 de la Ley 42/98, que señala uno mínimo de diez días a partir de la firma del contrato para desistir.
La consecuencia jurídica de esa anticipación en el pago del precio viene impuesta por la Ley, concretamente en su artículo 11.2 EDL 1998/46128 "Si el adquirente hubiera anticipado alguna cantidad del transmitente, tendrá derecho a exigir en cualquier momento la devolución de dicha cantidad duplicada".
La sentencia que condena a Royal Guest SL. a pagar el doble del precio anticipadamente recibido no infringe el citado art. 11.2 sino que lo aplica correctamente.
Por último, no resulta aplicable el art. 12 de la Ley porque aquí no se demanda la resolución del préstamo concedido por el Banco de Comercio, sino la devolución del precio anticipadamente satisfecho y previamente obtenido mediante ese negocio crediticio, cuya eficacia no es objeto de este pleito.
